1. Controller
The controller within the meaning of the General Data Protection Regulation (GDPR) is:
Essential Advertising GmbH
Managing Director: Daniel Klantke
Adenauerallee 2
61440 Oberursel
Phone: +49 (0)6172 90 84 747
Email: dk@essentialadvertising.de
2. The essentials
This website is deliberately built to be frugal: It uses no cookies, no services from Google or other advertising networks and no cross-site tracking. For audience measurement we operate our own cookie-free solution that stores no IP addresses (section 4). There are no user accounts. Further personal data only arises when you send us an email.
3. Hosting and server log data
When you access this website the web server automatically processes data transmitted by your browser. In particular: IP address, date and time of access, the page accessed, browser type and operating system as well as the previously visited page (referrer).
This processing is technically necessary in order to deliver the website and ensure its stability and security. The legal basis is Art. 6(1)(f) GDPR (legitimate interest). The log data is not combined with other data sources and is deleted after a short period.
The website is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, USA. Vercel processes the log data described above on our behalf under a data processing agreement (Art. 28 GDPR). This may involve a transfer to the USA; it is safeguarded by the European Commission’s standard contractual clauses (Art. 46 GDPR). Further information: vercel.com/legal/privacy-policy
4. Audience measurement without cookies
To understand which content is read we collect anonymous access statistics. We do not use a third-party service for this but a solution we operate ourselves. No cookies are set and no cross-site tracking takes place.
Recorded per page view: The page accessed, the previously visited page (referrer), campaign parameters from the address bar (utm), the country, the type of device, browser and operating system as well as the window width.
So that repeat visits within a single day are not counted twice, an identifier is derived from the IP address, browser identification, a secret additional value and the current date, and hashed using an irreversible procedure (SHA-256). The IP address itself is never stored. The identifier changes daily and allows no conclusions about you personally; recognition beyond the day is impossible.
We additionally count how often certain goals are reached, for example completing the enquiry, clicking our email address or opening the newsletter sign-up. Here too only totals are formed, never individual profiles.
Because no information is stored on or read from your device, no consent under section 25 TDDDG is required and there is no cookie banner. The legal basis for the processing is Art. 6(1)(f) GDPR. Our legitimate interest lies in designing our offering to meet demand. In our assessment the anonymisation described means there is no longer any personal reference.
The data is stored by Supabase Inc., 970 Toa Payoh North, Singapore, on servers in Frankfurt am Main (region eu-central-1) on our behalf under a data processing agreement (Art. 28 GDPR). Further information: supabase.com/privacy
You can object to the measurement by enabling the “Do Not Track” setting in your browser or by using a content blocker. This puts you at no disadvantage when using this website.
5. Contact by email
If you contact us by email we process the data you provide (your email address, the content of your message and, where applicable, your name) in order to answer your enquiry.
The legal basis is Art. 6(1)(b) GDPR where your enquiry concerns the conclusion or performance of a contract, otherwise Art. 6(1)(f) GDPR (legitimate interest in answering enquiries). We delete the data as soon as it is no longer required and no statutory retention obligations prevent this.
6. The guided enquiry on this website
While you answer the questions, your entries stay in your browser. They are only transmitted when you click “Send enquiry” at the end. They then reach us as an email through the sending service Resend. They are not stored on this website, we process them in our mailbox in order to answer your enquiry.
What is processed are the answers you filled in, together with your name and email address. The legal basis is Art. 6(1)(b) GDPR for pre-contractual measures, otherwise our legitimate interest in replying under Art. 6(1)(f) GDPR. We delete the enquiry once it has been dealt with and no statutory retention obligation applies.
You can use your own email programme instead, that link sits below the send button. Section 8 then applies to sending.
7. Signing up for new posts
On the blog page you can sign up to receive a short email whenever a new post goes up. Only your email address is collected for this. It is not stored on this website, it is passed straight to our newsletter software bemailed, operated by Essential Advertising GmbH, the same controller named under 1.
Sign-up uses a confirmed opt-in: After you enter your address you receive an email with a confirmation link. Only once you click it are you added to the list. If you do not confirm, the address is not used further. We record the time of sign-up and the confirmation in order to be able to demonstrate it.
The legal basis is your consent under Art. 6(1)(a) GDPR. You can withdraw it at any time without any disadvantage. Every email contains an unsubscribe link, one click is enough. After you unsubscribe the address is deleted, unless a statutory retention obligation applies.
8. Disclosure of data
Your data is not passed to third parties unless we are legally obliged to do so or disclosure is necessary to perform a contract.
9. Your rights
Under the GDPR you have the following rights:
- Access to the data processed (Art. 15 GDPR)
- Rectification of inaccurate data (Art. 16 GDPR)
- Erasure (Art. 17 GDPR)
- Restriction of processing (Art. 18 GDPR)
- Data portability (Art. 20 GDPR)
- Objection to processing based on Art. 6(1)(f) GDPR (Art. 21 GDPR)
To exercise your rights, an informal email to dk@essentialadvertising.de.
10. Right to lodge a complaint
You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is: Der Hessische Beauftragte für Datenschutz und Informationsfreiheit, Gustav-Stresemann-Ring 1, 65189 Wiesbaden, Germany.
11. Encryption
This website uses TLS encryption (recognisable by “https://” in the address bar). Data you transmit to us therefore cannot be read by third parties.
12. Changes to this privacy policy
We adapt this privacy policy when the website or the legal situation changes. The version published here applies.
